The South African laws pertaining to the subdivision of agricultural land prohibits farm land being subdivided without approval by the Department of Agriculture. Therefore, should you wish to bequeath your farm to your children in equal shares, for instance, such provision in your will is legally incorrect and is going to create many complications with the administration of your deceased estate. In this instance, there are mechanisms in the law which can be leveraged to help you achieve your goal, but this falls outside the ambit of the Quickwill service and we recommend you get tailored legal advice.
